NexusMart is a commercial marketplace and services platform operated by 13710645 Canada Ltd. These Affiliate Terms of Use (“Terms”) govern participation in any affiliate, referral, or partner program offered by NexusMart.
By enrolling in or participating in a NexusMart affiliate or referral program, you agree to be bound by these Terms, the NexusMart Terms of Service, and all incorporated policies.
1. Affiliate Relationship
Affiliates participate as independent contractors. Nothing in these Terms creates an agency, partnership, joint venture, employment, or fiduciary relationship between NexusMart (or 13710645 Canada Ltd.) and any Affiliate.
Affiliates have no authority to bind NexusMart or represent themselves as acting on behalf of NexusMart.
2. Eligibility & Enrollment
- Affiliates must provide accurate and complete registration information
- NexusMart may approve or reject affiliate applications at its discretion
- NexusMart may require additional verification or compliance information
NexusMart reserves the right to suspend or terminate affiliate participation for non-compliance.
3. Permitted Promotional Activities
Affiliates may promote NexusMart using approved links, banners, or marketing materials provided or authorized by NexusMart.
Affiliates must:
- Clearly disclose their affiliate relationship where required by law
- Use honest, accurate, and non-misleading promotional content
- Comply with applicable advertising, privacy, and consumer protection laws
4. Prohibited Activities
Affiliates may not:
- Engage in fraudulent, deceptive, or misleading promotions
- Use spam, unsolicited communications, or prohibited marketing methods
- Misrepresent NexusMart services, pricing, or guarantees
- Bid on restricted trademarks or impersonate NexusMart
- Generate self-referrals or manipulate tracking systems
Violations may result in forfeiture of commissions and termination.
5. Commissions & Payments
- Commission structures, rates, and eligibility criteria are defined by NexusMart and may vary by program
- Commissions are earned only on qualified and verified transactions
- Transactions subject to refunds, chargebacks, or fraud may be disqualified

6. Taxes
Affiliates are solely responsible for:
- Reporting and paying any applicable taxes on earned commissions
- Providing required tax documentation when requested
NexusMart does not provide tax advice.
7. Intellectual Property
Affiliates may use NexusMart trademarks or branding only as authorized.
Unauthorized use of NexusMart intellectual property is prohibited and may result in termination.
8. Termination
Either party may terminate affiliate participation:
- In accordance with program terms
- Immediately in cases of breach, fraud, or legal non-compliance
Upon termination:
- Unpaid commissions may be forfeited if earned through prohibited activity
- Affiliates must cease use of NexusMart branding and links
9. Limitation of Liability
To the maximum extent permitted by law:
- NexusMart is not liable for indirect or consequential damages
- Liability is limited in accordance with the NexusMart Terms of Service
Nothing in these Terms limits rights that cannot be excluded under applicable law.

These Affiliate Terms operate alongside:
- NexusMart Terms of Service
- Privacy Policy
- Community Guidelines
In the event of conflict, the NexusMart Terms of Service prevail.
